Specialisations:
Mark is a senior dispute resolution lawyer with a wealth of experience in commercial litigation, restructuring and insolvency law, and property disputes. He advises clients on a range of matters including contractual disputes, shareholder disagreements, commercial leasing disputes, restraint of trade matters, negligence claims, contentious estate litigation, and debt recovery matters. Mark is a confident advocate. He regularly appears in the District and High Courts and also represents clients at mediations and judicial settlement conferences.
Mark’s second specialty area is restructuring and insolvency law. He has considerable experience advising company directors, creditors, and insolvency practitioners on a range of insolvency matters including: company liquidations, administrations and receiverships, the contentious area of reckless trading and breach of director’s duties, unpaid current account claims, voidable transactions, securities enforcement, creditor claims, priority disputes under the Personal Property Securities Act 1999, applications for directions and qualification of liquidators, applications to set aside statutory demands, and personal bankruptcy proceedings. Mark also has an interest in construction matters that have an insolvency aspect or require enforcement proceedings. He is a member of the Restructuring Insolvency & Turnaround Association of New Zealand (RITANZ).
In the property space, Mark has acted on a wide range of property disputes and specializes in leasing disputes between commercial landlords and tenants. He recently co-presented a paper to the Auckland District Law Society Continuing Professional Development programme on protecting landlords from defaulting tenants.
Before joining C & F Legal Ltd, Mark was a senior lawyer at a leading national law firm in Auckland for 17 years. His many years of experience means he is well equipped to provide clients with commercial and practical advice. He works closely with the firm’s litigation team, Rick Farr, Andrew Shaw and James Miller. Outside of work, Mark is a keen hiker and is loving exploring all the fantastic tracks around Nelson.
